1. Introduction

Welcome to GougCash, an electronic wallet ("E-Wallet") provided by GougCash ("we", "us", "our"). By creating an account and/or using our Services, you ("User", "you", "your") agree to these Terms & Conditions ("Agreement"). This Agreement governs your access to and use of the GougCash E-Wallet platform, including any associated websites, mobile applications, and related services (collectively, the "Services").

2. Acceptance of Terms

By creating an account, you acknowledge that you have read, understood, and agree to be bound by this Agreement. If you do not agree to these terms, you must not register for or use the Services.

3. Modifications and Updates

GougCash reserves the right, at its sole discretion, to modify, update, or change any portion of this Agreement at any time without prior notice. Continued use of the Services after such modifications constitutes your acceptance of the revised Agreement. GougCash also reserves the right to revise transaction charges and fees at any time without prior notice.

4. User Responsibilities

You agree to provide accurate, current, and complete information during registration and to update such information when necessary. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Any unauthorized use or breach of your account is your responsibility, and GougCash shall not be held liable for any resulting losses.

5. Security and Account Hacking

Although GougCash employs industry-standard security measures, no system is completely secure. In the event of a breach, hacking incident, or unauthorized access, GougCash will take reasonable steps to secure your account; however, GougCash shall not be liable for any loss or damage arising from such events. You agree to notify us immediately if you suspect any unauthorized activity related to your account.

6. Transaction Charges and Fees

All transactions conducted via the GougCash E-Wallet may incur charges and fees, including, but not limited to, transaction fees, service fees, and currency conversion fees. GougCash reserves the right to adjust, increase, or modify these fees at any time without prior notice. By using the Services, you agree to pay all applicable fees as they become effective.

7. System Performance and Limitations

While GougCash strives to ensure a reliable and efficient system, we cannot guarantee uninterrupted, error-free, or fast performance. GougCash is not liable for any delays, system slowdowns, outages, or technical malfunctions, even if such issues arise from circumstances beyond our control. In no event shall GougCash be responsible for any indirect or consequential damages arising from system performance issues.

8. Abuse, Misuse, and Fraud

You agree to use the Services only for lawful purposes and in accordance with this Agreement. Any attempt to commit fraud, money laundering, or other criminal activities using the Services is strictly prohibited. GougCash reserves the right to suspend or terminate your account immediately if any misuse or abuse of the Services is suspected, without liability to you.

9. Limitation of Liability

To the fullest extent permitted by applicable law, GougCash shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, data loss, or other losses arising out of or related to your use of the Services. In no event shall our total liability exceed the fees paid by you for the Services in the preceding twelve (12) months.

10. Indemnification

You agree to indemnify, defend, and hold harmless GougCash and its affiliates, officers, directors, employees, and agents from any claims, losses, liabilities, damages, expenses, and costs (including reasonable attorneys’ fees) arising from your breach of this Agreement, your use of the Services, or your violation of any law or the rights of any third party.

11. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of Zimbabwe. You hereby consent to the exclusive jurisdiction and venue of the courts located in Zimbabwe for the resolution of any disputes arising out of or relating to this Agreement or your use of the Services.

12. Severability

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. No Waiver

The failure of GougCash to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision. No waiver shall be effective unless in writing and signed by an authorized representative of GougCash.

14. Entire Agreement

This Agreement constitutes the entire agreement between you and GougCash regarding the use of the Services and supersedes all prior and contemporaneous communications, proposals, and representations, whether oral or written.

FAQ 1: Is GougCash account creation free or paid?
Answer: Creating a GougCash E-Wallet account is free of charge.
FAQ 2: What are the requirements for creating a GougCash Account?
Answer: You need to complete all the mandatory fields in the account creation form with accurate details and agree with the terms and conditions of GougCash. You should be at least 18 years of age.
FAQ 3: What can I use a GougCash Wallet for?
Answer: GougCash Wallet is the most convenient E-Wallet for keeping your USD safe at no cost. You can easly send or receive USD transactions to or from other GougCash registered users. Its the easiest and cheapest way to receive payments or settle your obligations.
FAQ 4: Where do I get a User ID? How do I create a new User 1D?
Answer: You create your own user ID. The easiest way to formulate your own user ID is by using your phone number starting with 100. Using your own phone number makes it easy to remember your User ID. For example: If your phone number is 07123456789, your User ID can be 1007123456789. If your phone number is already associated with another registered user ID, you can try to change the second digit of your phone number because in the user ID, that can be any digit from 1 to 9. Eg: for phone number above, the user ID can be 1006123456789 by changing the digit 7 to 6. All user IDs start with 100 followed by any digit between 1 to 9, followed by any 8 digits of your choice from 0 to 9.
FAQ 5: What are the GougCash Wallet associated charges?
Answer: Cash deposite is free. Cash withdrawal is free. No monthly account service charges. No cost to receive payments from users. GougCash only charges 0.5% of the sent amount when sending money to someone.
FAQ 6: Is there a preset minimum or maximum account balance allowed?
Answer: The minimun wallet balance is US$0.00. And there is no maximum limit on user wallet balance.
FAQ 7: Are there any maximum daily transaction limits?
Answer: You can send or receive any amount in a single day. GougCash sending transactions are unlimited. Currently, the maximum daily withdrawal limit is five-thousand United States Dollars (US$5,000.00).
FAQ 8: Can I update my information after registrantion?
Answer: Yes. You can update most of your user profile information except User ID and names. First login to your Account. To access your user profile dashboard, click the Gear icon on the bottom left conner on the user's dashboard, enter your login password to access the user profile dashboard.
FAQ 9: I forgot my password. How can I recover it?
Answer: Contact GougCash Support Team by email at gougcash-support@sfriz.com and unswer a few security questions. Normally they respond within a few hours during working days. You should be responsible for your Wallet credentials.
